This document outlines the terms of service for ByHand.me. By agreeing to the terms and conditions outlined here, you (the user) accept that this is a legally binding document between yourself and ByHand.me. ByHand.me is a social community for handmade artisans. Users may post material related to their shops and craft on this site, however, ByHand accepts no responsibility, nor shall be held liable for the material that is posted as a result of usage of the website.2. Service
All users must agree to, and comply absolutely, with the terms and conditions set forth by this document. By agreeing to the terms and conditions, and will be considered a legally binding contract between you and ByHand.
Access to and usage of the site is free for all users. It is the sole discretion of ByHand to grant site usage, as well as to revoke site usage at any time, for any reason and without notice to you. ByHand will not be held liable to you or any third party for the termination of your account, or restriction from website usage. ByHand retains the right to refuse service to any member and suspend any users account at its sole discretion.3. Eligibility
To access and utilize the resources on the site you must be a registered user. ByHand’s services are only available to users who are 18 years of age or older and can legally create a binding Contract between buyer and seller. Users who are not 18 years of age can participate if they are supervised by a parent or legal guardian over the age of 18. In this case, the parent or legal guardian assumes responsibility of all activities carried out by the user. ByHand shall not be held responsible for any damages incurred by non-commitment to this policy.4. Artisan Directory Listings
Further, you as a registered user, agree to comply with the rules and regulations of ByHand, and shall not act in a manner that hinders or prohibits ByHand from conducting business. Users hereby agree to act accordingly with local, national and international laws regarding acceptable content and conduct.
ByHand provides a platform for artisans to promote their handmade goods and online shops. Users may only register shops for the artisan directory that are handmade. Vintage and commercial supplies are not allowed in the Artisan Directory. (Handmade supplies are okay.) Any directory listing that does not meet this criterion will be removed at ByHand’s discretion, and the user’s account will be evaluated for possible termination. ByHand reserves the right to review a user’s account at anytime and without notice. ByHand reserves the right to remove content which is deemed to be inappropriate or that could subject ByHand to legal action.5. Forum Usage
ByHand provides a forum for artisans to promote their handmade goods and online shops as well as discuss online selling and marketing. We do provide some general areas that do not relate to these topics, and as such we ask you to keep off topic discussions to those areas. Any forum entry that does not meet this criterion will be removed or locked at ByHand’s discretion, and the user’s account will be evaluated for possible termination. ByHand reserves the right to review a user’s account at anytime and without notice. ByHand reserves the right to remove content which is deemed to be inappropriate or that could subject ByHand to legal action.6. Blog Usage
ByHand provides a blog for artisans to promote their handmade goods, shops, and information regarding their craft. Users may post what they like to their blog as long as it is not contain spam, racist, threatening, or hate related material. Pornography is not allowed, however, mature subject matter is okay as long as it is artistic in nature. In the interest of not offending members of different backgrounds, ByHand requests that you do not post mature blog material to the front page. Repeatedly posting blog entries in the interest of only promoting your online venues to the front page is also prohibited. Feel free to blog about a sale or contest you are having, but please try to keep the front page blog entries free of other promotional material. Please note that repeatedly posting blog entries promotional material to the front page for the purpose of bumping yourself up is prohibited. Posting about your work, sales and contests is fine, however please do not post the same deals more than once before their expiration. Also, front page blog entries should consist of several paragraphs. Short one paragraph entries and one liners will be removed from the front page. (It is okay to post about your craft, handmade product reviews, tutorials, and artist interviews and post them to the front page. Please see ByHand's Help page for clarification on what is allowed.) Any blog listing that does not meet this criterion will be removed at ByHand’s discretion, and the user’s account will be evaluated for possible termination. ByHand reserves the right to review a user’s account at anytime and without notice. ByHand reserves the right to remove content which is deemed to be inappropriate or that could subject ByHand to legal action.
7. Spotlight Usage
ByHand provides Spotlights as a free way to promote handmade, artisan items. As Spotlights can be seen through ByHand's Window Shop feature on the front page as well as on other sites across the web, the submission of mature items to Spotlights is prohibited. ByHand does allow users to upload their own products to Spotlights for promotional purposes. However, repeatedly creating Spotlights with the same items for the sake of increasing exposure is prohibited. Any Spotlight that does not meet this criterion will be removed at ByHand’s discretion, and the user’s account will be evaluated for possible termination. ByHand reserves the right to review a user’s account at anytime and without notice. ByHand reserves the right to remove content which is deemed to be inappropriate or that could subject ByHand to legal action. As Spotlights are a communty feature, ByHand encourages users to create Spotlights with items from handmade shops other than their own. Spotlights created with items from shops other than the users shop may be posted to the front page blog. Spotlights with the users own items may be posted to the front page blog for a one time introduction with content - it cannot be a stand alone Spotlight - or as part of a user's contest or sale as long as additional content is provided.
8. Infringement of Policy
All users of ByHand.me must agree to be held legally liable for infringement of these policies. ByHand will provide such parties that enforce these laws with all applicable information should such a violation occur. The user is responsible for any and all conduct and activity that pertains to posting on ByHand.me. This should include images, copy, text, data, graphics, usernames, email addresses, photographs, profiles, avatars, videos, items, products, audio and links that are posted to and displayed on ByHand.me.9. Dispute Resolution

In the event that a dispute arises between one or more users of the ByHand site, or a 3rd party, ByHand will be considered free of any and all claims, damages or demands created by the dispute. While we try and maintain a safe, free social network, ByHand has no obligation to mitigate or resolve disputes between users and other parties. ByHand encourages users to use the proper local, national or international authorities to assist in dispute resolution.
All domains, graphics, images, photography, copy, text, video and audio, including buttons, headers, links, footers is considered the trade dress of ByHand.me. Any and all data aforementioned is copyrighted and may not be used with out the express written permission of ByHand.11. Disclaimer of Warranties
By registering as an ByHand.me user, you herby agree that:12. Severability
You use the ByHand.me site and service with the knowledge that it is at your own risk. The website and service are provided “as is” and no warranty or guarantee is implied as pertains to availability, access, or transaction.
ByHand and its officers, managers, agents, staff, suppliers, subsidiaries, and affiliates are in no way liable for the availability, accessibility, merchantability, marketability, performance, fitness or reliability of the ByHand site and services.
No advice or other information provided by ByHand and its officers, managers, staff, suppliers, subsidiaries and affiliates shall create any warranty our guarantees.
If any portion of this agreement shall be held invalid by court of competent jurisdiction the remaining portions of the agreement shall remain in effect. Where modification to reflect intent or provide clarification to the service terms is allowed for any invalidated portion, such remedy shall be made first before any clause is held null and void.13. Venue
This contract and any dispute arising there from shall be governed by the laws of Virginia.
